And Others Seller Terms and Conditions

Launch note: These marketplace terms should be reviewed by a UK solicitor before commercial launch.

1. About And Others

And Others provides online marketplace, shop hosting, discovery and related technology for independent UK sellers. Unless expressly stated otherwise, And Others is not the seller of goods or services listed by shop owners. A customer’s purchase contract is with the individual shop owner.

2. Eligibility and authority

You must provide accurate information, be legally able to enter a contract and have authority to act for any business you register.

3. Your shop and account

You are responsible for account security, shop content, prices, stock, service availability, customer information and keeping your details current.

4. Products, services and content

You may list only lawful goods and services that you are entitled to sell. Listings must be accurate and must not be misleading, unsafe, counterfeit, infringing, discriminatory, obscene or otherwise prohibited. Images and text must be yours or used with permission.

5. Consumer law

You are responsible for UK consumer protection requirements including accurate pricing and descriptions, cancellation rights where applicable, refunds, faulty-goods remedies and pre-contract information. Statutory rights are unaffected.

6. Prices, VAT and tax

You set your prices and are responsible for VAT, tax, invoices and fiscal obligations that apply to you.

7. Payments

Supported payment providers such as Stripe and PayPal operate under their own terms and charges. And Others does not guarantee provider acceptance or continued service.

8. Orders, delivery and services

You are responsible for fulfilment, delivery or collection, service appointments, customer communication and resolving fulfilment problems.

9. Shop subscriptions

Shop fees are charged according to the selected plan. The Starter plan is currently £24 per year. Future pricing may change with reasonable notice and will not retrospectively alter a completed paid period.

10. Discounts and referrals

Promotional codes have their own rules. Affiliate and salesperson attribution is determined by And Others records. Sham transactions or referral manipulation are prohibited.

11. Reports and moderation

Users may report shops, listings, images and other content. And Others may investigate, request information, hide content, suspend a listing or shop, or take proportionate action for safety, legal compliance or marketplace integrity.

12. Intellectual property

You retain your rights in content you own and grant And Others a non-exclusive licence to host, resize, display, index and promote it as necessary to operate and market the marketplace and your shop.

13. Data protection

Both parties must comply with applicable UK data-protection law. Customer information supplied for fulfilment must be protected and used lawfully.

13A. Seller contact forms

Sellers may optionally connect their own Formspree form endpoint to a predefined And Others contact page. The seller is responsible for its Formspree account, destination email, responses, privacy information and lawful handling of customer enquiries. And Others does not receive the contents of messages submitted directly to a seller through that seller’s Formspree endpoint.

14. Suspension and termination

We may suspend or close shops for serious or repeated breaches, fraud, non-payment, unlawful activity, security risks or legal requirements. Records may be retained for accounting, disputes, fraud prevention or law.

15. Availability

We aim to keep And Others available but cannot guarantee uninterrupted operation. Maintenance and third-party failures may cause disruption.

16. Liability

Nothing excludes liability that cannot lawfully be excluded. Sellers remain responsible for their own business, listings, goods, services, customers and legal obligations. Final liability limits require UK legal review.

17. Governing law

These terms are governed by the law of England and Wales. The parties should first try to resolve disputes through the And Others complaints process.

18. Free Promote Your Shop tools

Every active And Others shop includes access to the Promote Your Shop guidance and promotional tools at no additional charge. These may include guidance for Google Business Profile, social-media post ideas, ready-made links, QR-code guidance and promotion checklists. These tools are intended to help sellers market their own businesses and may include appropriate And Others branding or links. They do not guarantee traffic, search ranking, enquiries or sales. Optional paid featured placement or advertising on And Others is separate and is never required to use the free promotion tools.

18A. Rewind and version history

And Others may retain recent shop-content and catalogue snapshots to help sellers recover from mistakes. Rewind is a convenience and is not a substitute for the seller keeping appropriate business records. Orders, payments, customer records, reports and accounting records are not rewound. Snapshot retention periods may be limited.

18B. Bulk uploads

Bulk spreadsheet uploads are treated as untrusted input. And Others may reject unsupported, malformed, macro-enabled or suspicious files, ignore unknown columns, sanitise imported text and impose file, row and field limits. Sellers remain responsible for checking imported listings before publication.

19. Changes and acceptance

Material changes receive a new version. Sellers may be required to actively accept a later version before continuing to trade. And Others records the account, shop, version and acceptance time.
